Getting arrested is a stressful and overwhelming experience. Your actions in those first critical moments can significantly impact the outcome of your case.
At Adlai Law, we’ve seen too many people make mistakes that make their legal situations worse. Knowing what not to do can help protect your rights and give you a better chance of a successful defense.
1. Do NOT Argue with the Police 🚔
When emotions are running high, it’s easy to feel the need to defend yourself or challenge the officer. However, arguing, resisting, or becoming aggressive will only make things worse. Officers may escalate the situation, and you could even face additional charges such as resisting arrest or obstruction of justice.
🔹 What to Do Instead: Stay calm, be polite, and comply with lawful orders. Anything you say can be used against you, so it’s best to remain silent until you speak with a lawyer.
2. Do NOT Admit Guilt or Give Statements 🛑
Many people believe that explaining their side of the story will clear things up. Unfortunately, even an innocent statement can be twisted and used against you in court.
🔹 What to Do Instead: Exercise your right to remain silent. Simply say: “I want to speak with my lawyer.” Then, say nothing else until your attorney arrives.
3. Do NOT Post About Your Arrest on Social Media 📱
We get it—social media is how many people share their lives. But posting about your arrest, your version of events, or even jokes about the situation can seriously harm your defense. Prosecutors and law enforcement can use your social media posts as evidence against you.
🔹 What to Do Instead: Avoid discussing your arrest with anyone except your lawyer. Stay off social media, and ask friends or family not to post about it either.
4. Do NOT Consent to a Search Without a Warrant 🔍
If the police ask to search your car, home, or personal belongings, you have the right to refuse unless they have a warrant. Voluntarily consenting to a search can lead to unnecessary evidence against you.
🔹 What to Do Instead: Politely state, “I do not consent to a search.” If they proceed anyway, don’t resist—but make it clear that you do not agree to the search.
5. Do NOT Assume You Don’t Need a Lawyer ⚖️
Many people think they can talk their way out of charges, or that their case isn’t serious enough for legal representation. This is a huge mistake. Even minor charges can have long-term consequences, including a criminal record, fines, and even jail time.
🔹 What to Do Instead: Call a criminal defense lawyer immediately. The sooner you have legal representation, the better your chances of a favorable outcome.
